Note: These terms and conditions may be modified at any time by SASU LEX GLOBO, particularly to reflect changes in applicable regulations, Platform functionalities, or service operating conditions. The applicable version is the one accessible on the Platform on the date of any use or subscription.

Article 1 — Definitions

In these Terms of Use, the following terms have the meanings set out below:

  • Platform: means the LEX GLOBO® website, accessible at www.lexglobo.com, published and operated by SASU LEX GLOBO.
  • User or Client: means any natural or legal person creating an account on the Platform for the purpose of searching for a lawyer and getting in touch with that lawyer.
  • Lawyer: means any lawyer duly admitted to a bar association, listed on the Platform under a subscription.
  • Lawyer Profile: means the Lawyer's profile as it appears on the Platform, including their professional information, specialties, languages and contact details.
  • Review: means the comment and/or rating left by a User on the Lawyer Profile of a Lawyer listed on the Platform.
  • Account: means the User's personal area created upon registration on the Platform.

Article 2 — Purpose

These Terms of Use govern the conditions of access to and use of the Platform by the User.

The Platform is a free service connecting Users searching for a lawyer with listed Lawyers. LEX GLOBO acts solely as a technical intermediary and does not provide any legal services.

Article 3 — Acceptance of the Terms of Use

The creation of an Account on the Platform constitutes full and unconditional acceptance of these Terms of Use. The User acknowledges having read and accepted them prior to any use of the Platform.

The applicable Terms of Use are those in force on the date of use of the Platform.

Article 4 — Registration and User Account

4.1 — Account creation

Access to the Platform's features (consulting Lawyer Profiles, contacting a Lawyer, posting Reviews) requires the prior creation of an Account.

The User undertakes to provide accurate and complete information when registering and to keep it up to date.

4.2 — Account security

The User is solely responsible for keeping their login credentials confidential. Any use of the Account is deemed to have been made by the User. In the event of unauthorised use of the Account, the User undertakes to inform LEX GLOBO without delay at [email protected].

4.3 — Personal Account

The Account is strictly personal and non-transferable. It may not be assigned, lent, or made available to any third party for any reason whatsoever.

4.4 — Age requirements

Registration on the Platform is reserved to adults. Minors aged fifteen (15) years and over may register subject to the prior authorisation of a holder of parental authority.

Article 5 — Description of services

5.1 — Connecting Users and Lawyers

The Platform allows the User to search for a Lawyer by geographic area, specialty, language or any other available search criterion, and to get in touch with that Lawyer.

LEX GLOBO does not intervene in any way in the relationship between the User and the Lawyer. The decision to engage the services of a Lawyer is the sole responsibility of the User.

5.2 — Free of charge

Access to the Platform and the use of the search and contact services are entirely free for the User. LEX GLOBO nevertheless reserves the right to offer paid services in the future, the conditions of which will be set out in specific terms.

5.3 — Reviews

The User may post a Review on the Lawyer Profile of a Lawyer with whom they have had an exchange or whose services they have used.

In accordance with article L.111-7-2 of the French Consumer Code and articles D.111-17 et seq. of the same code, LEX GLOBO informs the User that:

  • Reviews published on the Platform are subject to moderation control before or after publication;
  • LEX GLOBO verifies, by any appropriate means, that the author of a Review has actually had an exchange with the Lawyer concerned or used their services via the Platform;
  • Reviews are sorted by default in chronological order, from the most recent to the oldest;
  • the date of publication of the Review and, where available, the date of the experience concerned are displayed;
  • if the publication of a Review is refused, the User is informed of the reasons for that refusal;
  • the Lawyer concerned by a Review has a right of reply, published following the Review.

The User undertakes that their Reviews shall be truthful, based on a real experience and compliant with applicable laws. The following Reviews are in particular prohibited:

  • defamatory, abusive, discriminatory or contrary to public order;
  • false or misleading;
  • infringing the Lawyer's professional secrecy;
  • posted in exchange for any financial or other benefit;
  • posted repeatedly with the intent to harm a Lawyer.

LEX GLOBO reserves the right to moderate, suspend or remove any Review that does not comply with these Terms of Use, without notice or compensation.

The User is solely responsible for the content of their Reviews. They indemnify LEX GLOBO against any claim or action by a Lawyer or any third party related to the content of a Review they have posted.

Article 6 — User obligations

The User undertakes to:

  • use the Platform in accordance with its intended purpose and these Terms of Use;
  • not use the Platform for illegal, fraudulent or public-order-infringing purposes;
  • not publish unlawful, defamatory, abusive, discriminatory, obscene content or content infringing third-party rights;
  • not attempt to interfere with the technical functioning of the Platform, in particular by introducing viruses, malicious software or by any unauthorised access attempt;
  • not collect or extract data from the Platform by automated means (scraping, harvesting);
  • not impersonate a third party.

Article 7 — Reporting illegal content

In accordance with article 16 of Regulation (EU) 2022/2065 (DSA), any User may report to LEX GLOBO content they consider illegal, by sending a notification to [email protected] or via the reporting mechanism available on the Platform.

The notification must contain: identification of the content concerned (link or description), the reasons why the User considers the content to be illegal, and the contact details of the notifier.

LEX GLOBO examines any notification as soon as possible and informs the notifier of the action taken on their request.

Article 8 — Account suspension and deletion

8.1 — Suspension for remediable breach

In the event of a breach by the User of these Terms of Use that can be remedied, LEX GLOBO will send the User a warning by email specifying the nature of the breach and inviting them to remedy it within fifteen (15) days. Failing rectification within this period, LEX GLOBO may suspend or delete the User's Account.

The following are in particular considered remediable breaches: providing incomplete or outdated information, posting a Review that does not comply with the rules set out in article 5.3.

8.2 — Immediate deletion for serious misconduct

LEX GLOBO may suspend or delete the User's Account without notice or compensation, by simple electronic notification, in the following cases:

  • fraudulent or abusive use of the Platform;
  • identity theft;
  • publication of manifestly illegal, defamatory, discriminatory content or content infringing third-party rights;
  • any attempt to interfere with the technical functioning of the Platform.

8.3 — Deletion by the User

The User may delete their Account at any time from their personal area or by sending a request to [email protected].

Article 9 — Description of services and availability of Lawyers

The Platform allows the User to search for a Lawyer by geographic area, specialty, language or any other available search criterion, and to get in touch with that Lawyer.

LEX GLOBO does not guarantee the availability of listed Lawyers in all countries or territories. The presence of Lawyers on the Platform in a given country or geographic area depends solely on their voluntary registration on the Platform. LEX GLOBO cannot be held liable for the absence of listed Lawyers in a given country or territory at the time the Platform is used.

Article 10 — Liability

10.1 — LEX GLOBO's role

LEX GLOBO acts as a technical intermediary connecting Users and Lawyers. LEX GLOBO does not provide any legal services and is not a party to the relationship between the User and the Lawyer.

LEX GLOBO cannot be held liable for:

  • the quality, compliance or suitability of the services provided by a Lawyer;
  • the conduct of a Lawyer or a User on the Platform or elsewhere;
  • any dispute arising between the User and a Lawyer;
  • the accuracy, completeness or up-to-date nature of the information appearing on Lawyer Profiles, which is filled in by the Lawyers themselves.

Any dispute relating to the legal services provided by a Lawyer, fees or the relationship between the User and the Lawyer falls within the exclusive jurisdiction of the disciplinary bodies of the bar association to which the Lawyer belongs, in accordance with the provisions applicable in the Lawyer's country of registration.

10.2 — Verification of Lawyers

LEX GLOBO carries out a documentary verification of each Lawyer's registration with a bar association. This verification does not in any way constitute a guarantee of the competence, quality or ethical compliance of the Lawyer's services.

The User is invited to carry out their own checks and to exercise their free choice in selecting a Lawyer.

10.3 — Limitation of liability

As the Platform is a free technical intermediation service, LEX GLOBO's liability towards the User can only be engaged in the event of proven fault by LEX GLOBO in the performance of its own obligations under these Terms of Use.

In any event, LEX GLOBO cannot be held liable for indirect damages such as loss of opportunity, commercial loss or damage to reputation.

LEX GLOBO cannot be held liable for damages resulting from the relationship between the User and a Lawyer, that relationship being independent of the Platform.

Article 11 — Intellectual property

The LEX GLOBO® trademark, the logo, the design of the Platform, the 3D globe, the texts, the architecture and all the visual and functional elements of the Platform are the exclusive property of SASU LEX GLOBO.

Any reproduction, representation, modification, adaptation or exploitation, in whole or in part, of the Platform or any of its elements, without the prior written authorisation of LEX GLOBO, is prohibited and constitutes an act of infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

Article 12 — Availability of the Platform

LEX GLOBO undertakes to use the means necessary for the proper functioning of the Platform. However, LEX GLOBO does not guarantee uninterrupted access to the Platform and cannot be held liable for interruptions due to:

  • preventive or corrective maintenance operations;
  • cases of force majeure within the meaning of article 1218 of the French Civil Code;
  • malfunctions attributable to third parties (host, internet service provider).

Article 13 — Personal data

LEX GLOBO collects and processes the User's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and French law no. 78-17 of 6 January 1978 as amended.

The terms of collection, processing and protection of personal data are described in LEX GLOBO's Privacy Policy, accessible on the Platform and constituting a separate regulatory information document.

The User has a right of access, rectification, erasure, restriction, portability and objection to the processing of their personal data, which they can exercise by sending a request to [email protected].

Article 14 — Account deletion and fate of data

In the event of Account deletion, the User's personal data is retained and deleted in accordance with the periods set out in LEX GLOBO's Privacy Policy, accessible on the Platform. As an indication, data is kept for three (3) years from the deletion of the Account or from the last activity, unless longer legal retention obligations apply.

Reviews posted by the User may be retained in anonymised form after the Account is deleted.

Article 15 — Cookies

The Platform uses cookies and trackers in accordance with applicable regulations, in particular Directive 2002/58/EC as amended and the CNIL's guidelines.

The terms of use of cookies, the purposes pursued and the means of accepting or refusing them are described in LEX GLOBO's Privacy Policy, accessible on the Platform.

Article 16 — Consumer mediation

In accordance with articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, the User has the right to use a consumer mediator free of charge with a view to the amicable resolution of any dispute with LEX GLOBO.

Before referring the matter to the mediator, the User must first have attempted to resolve their dispute directly with LEX GLOBO by sending a written complaint to the email address [email protected].

The User may also use the European Online Dispute Resolution (ODR) platform available at the following address: https://ec.europa.eu/consumers/odr.

Article 17 — Notifications

Any communication from LEX GLOBO to the User is sent by email to the email address provided at the time of registration.

The User is responsible for keeping their email address up to date. Any notification sent to the last address communicated is deemed to have been validly delivered.

Article 18 — Modification of the Terms of Use

LEX GLOBO reserves the right to modify these Terms of Use at any time. Any modification will be brought to the User's attention by any appropriate means (notification on the Platform, email) at least fifteen (15) days before its entry into force.

Continued use of the Platform after the entry into force of the new Terms of Use constitutes acceptance thereof. Failing acceptance, the User may delete their Account under the conditions set out in article 8.3.

Article 19 — Evidence agreement

The parties agree that the computer records kept in LEX GLOBO's information systems (connection logs, time-stamping of acceptances, history of Reviews) shall have probative value and constitute admissible, valid and enforceable evidence.

Article 20 — Severability

If any of the provisions of these Terms of Use is declared null or unenforceable by a court decision that has become final, the other provisions shall remain in force and shall retain their full binding force.

Article 21 — Entire agreement

These Terms of Use and the Privacy Policy constitute the entire agreement between LEX GLOBO and the User relating to the use of the Platform.

Article 22 — Applicable law and jurisdiction

These Terms of Use are drafted in French. In case of translation, only the French version shall prevail.

These Terms of Use are governed by French law.

In the event of a dispute, the User is invited to first contact LEX GLOBO with a view to an amicable settlement. Failing an amicable solution, the User may refer the matter to the consumer mediator under the conditions set out in article 16 or to the competent courts in accordance with the rules of common law.
